Chicken Road App Terms of Service

Welcome to Chicken Road! These Terms of Service ("Terms") govern your access to and use of the Chicken Road mobile application, website, and related services (collectively, the "Services") provided by Chicken Road App Studios ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services. Your journey on the "Chicken Road" is subject to these rules and regulations outlined herein. Please read them carefully before proceeding on your adventure.

1. Acceptance of Terms

By creating an account, downloading the app, or otherwise accessing or using the Services, you represent that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an entity, you represent that you are authorized to accept these Terms on that entity's behalf. The "Chicken Road" experience we offer is conditional upon your unwavering acceptance of all stated terms. Failure to comply may result in termination of your access to the myriad paths of the Chicken Road.

2. License to Use Our Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the Chicken Road mobile application on a device that you own or control and to run such copy of the application solely for your own personal, non-commercial entertainment purposes. This license defines your right of way on the Chicken Road. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Chicken Road App Studios, in the manner permitted by these Terms. Any deviation from this path is strictly prohibited.

You agree not to: (a) copy, modify, or create derivative works based on the Services; (b) distribute, transfer, sublicense, lease, lend, or rent the Services to any third party; (c) reverse engineer, decompile, or disassemble the Services, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Services; or (d) make the functionality of the Services available to multiple users through any means, including but not limited to, network shares or virtualized environments. Each Chicken Road is meant for a single traveler at a time per license.

3. Accounts and Conduct on the Chicken Road

To access certain features of the Chicken Road, you may need to create an account. You are responsible for safeguarding your account details (your "Coop Key") and for any activities or actions under your account. You agree to:

  • Provide accurate, current, and complete information during the registration process and keep your Coop Key secure.
  • Maintain and promptly update your account information to keep it accurate, current, and complete.
  • Not share your password or Coop Key or let anyone else access your account or do anything else that might jeopardize the security of your account.
  • Notify us immediately if you suspect any unauthorized use of your account or any other breach of security on the Chicken Road.

When using the Chicken Road Services, you agree to traverse its paths respectfully and not engage in any conduct that:

  • Violates any applicable law or regulation, or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability.
  • Is fraudulent, false, misleading, or deceptive, such as attempting to impersonate another chicken on the road.
  • Is defamatory, obscene, pornographic, vulgar, or offensive to other travelers on the Chicken Road.
  • Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. The Chicken Road is for all fowls.
  • Is violent or threatening or promotes violence or actions that are threatening to any other person or entity.
  • Infringes, misappropriates, or violates a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy. Do not steal other chickens' shiny feathers.
  • Interferes with or disrupts the Services or servers or networks connected to the Services, or disobeys any requirements, procedures, policies, or regulations of networks connected to the Services, thereby blocking the Chicken Road for others.
  • Attempts to gain unauthorized access to the Services, other accounts, computer systems, or networks connected to the Services, through hacking, password mining, or any other means.
  • Uses any meta tags or other hidden text or metadata utilizing a Chicken Road trademark, logo URL or product name without our express written consent.

Violating these rules of the Chicken Road may result in temporary suspension or permanent termination of your account, and you may be banished from all future Chicken Road crossings.

4. Virtual Items and In-Game Purchases

The Services may include virtual currency, such as "Golden Corn" or "Shiny Pebbles" ("Virtual Currency"), and virtual items, such as unique chicken skins, accessories, or power-ups ("Virtual Goods"), that can be purchased with real money or earned through gameplay on the Chicken Road. These Virtual Currency and Virtual Goods are licensed to you, not sold. You do not own them, and they do not have any real-world monetary value. Your right to use these Virtual Items is limited to the Services and cannot be transferred or redeemed for cash or other goods or services. Any purchases of Virtual Currency and Virtual Goods are final and non-refundable, except as required by applicable law or at our sole discretion. We may manage, regulate, control, modify, or eliminate Virtual Currency and/or Virtual Goods at any time, with or without notice, and we will have no liability to you or any third party if we exercise such rights. The exchange rate for Virtual Currency and the availability of Virtual Goods along the Chicken Road are subject to change.

5. Intellectual Property Rights

All rights, title, and interest in and to the Services (including, without limitation, all games, titles, computer code, themes, objects, characters like "Clucky the Brave" or "Sir Reginald Peckington", character names, stories, dialogue, catchphrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a Chicken Road game client, and the Chicken Road game clients and server software) are owned by Chicken Road App Studios or its licensors. The "Chicken Road" brand, logos, and all associated trademarks and service marks are the exclusive property of Chicken Road App Studios. These Terms do not grant you any rights to use our intellectual property except for the limited license granted above to traverse the digital Chicken Road. Any unauthorized use may lead to legal action.

6. User-Generated Content on the Chicken Road

If you submit, upload, publish, or transmit any content through the Services, such as custom chicken designs, fan art, forum posts, or chat messages related to your Chicken Road experiences ("User Content"), you grant Chicken Road App Studios a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit your User Content in connection with the Services and our business (and that of our successors and affiliates), including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels. You represent and warrant that you have all rights necessary to grant such licenses to us without infringement or violation of any third-party rights. User Content must not obstruct or deface the Chicken Road for others.

7. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CHICKEN ROAD APP STUDIOS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICES, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SERVICES. YOUR JOURNEY ON THE CHICKEN ROAD IS AT YOUR OWN SOLE RISK. SOME "CHICKEN ROADS" MAY BE MORE PERILOUS THAN ADVERTISED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHICKEN ROAD APP STUDIOS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF CHICKEN ROAD APP STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES OR ANY SPECIFIC "CHICKEN ROAD"; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE LAST SIX MONTHS FOR THE SERVICES.

8. Termination of Your Chicken Road Journey

We may terminate or suspend your access to all or part of the Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services and traverse the Chicken Road will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State/Jurisdiction, e.g., California], United States, without regard to its conflict of law principles. You agree that any dispute arising from or relating to the subject matter of these Terms shall be governed by the exclusive jurisdiction and venue of the state and Federal courts of [Your County, Your State, e.g., Santa Clara County, California]. This is the final fork in the Chicken Road for dispute resolution.

10. Changes to These Terms or the Chicken Road

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms for your Chicken Road journey, you must stop using the Services. We may also, in the future, offer new services and/or features through the Services (including, the release of new tools, resources, and new "Chicken Roads"). Such new features and/or services shall also be subject to these Terms of Service.
